So what we re going to discuss is the SharifFamily’s name in Panama Leaks, along with that we ll be discussing Imran Khan’scase in Supreme Court regarding his offshore company and London Flats. So letsjust move on towards Panama Issue first because this Panama Leaks has beendominating Pakistani Politicis for the last few years.(Pictures regarding Panama Leaks) The Panama Papers are 11.5 million leakeddocuments that detail financial and attorney–client information for more than214,488 offshore entities. The documents, some dating back to the 1970s, werecreated by, and taken from, Panamanian law firm and corporate service providerMossack Fonseca, and were leaked in 2015 by an anonymous source.

The documents contain personal financialinformation about wealthy individuals and public officials that had previouslybeen kept private. While offshore business entities are legal (see OffshoreMagic Circle), reporters found that some of the Mossack Fonseca shellcorporations were used for illegal purposes, including fraud, tax evasion, andevading international sanctions.Among them was the Pakistani prime minister NawazSharif’s family as  well.The leaks in April 2016 revealed that formerPakistani Prime Minister Nawaz Sharif’s children owned offshore companies andassets not shown on his family’s wealth statement.

The companies identified so far include threeBritish Virgin Islands-based companies Nescoll Ltd, Nielsen Enterprises Ltd andHangon Property Holdings Ltd, incorporated in 1993, 1994 and 2007 respectively.These companies have been used to channel fundsto acquire foreign assets, including some apartments along Park Lane inLondon’s Mayfair area.Mr Sharif and his family denied wrongdoing.According to them they were rich, there grandfather was rich, OH NO NO NO!  there grandfather was poor farmeeerrrr. Other political leaders alsoexpressed support for the petition.

It targeted Sharif’s children, hisson-in-law Muhammad Safdar, and his brother-in-law and the former financeminister Ishaq Dar as well. PTI workers staged a sit-in outside Sharif’sprivate residence at Raiwind near Lahore on 30 September 2016. Khansubsequently called on supporters to “lock-down” Islamabad untilNawaz Sharif “resigned or presented himself for accountability”.

So this is how the case against Sharif Family inSupreme Court started but before we move on to what actually happened duringthe case. I will discuss  the londonflats and the offshore companies of Sharifs as they are linked with eaach otherand the whole case revolves around it.Okay so the idea of London flats is quiet funnybecause there are different statements by the Sharif Family and Ch Nisar. The role of off-shore companies is criticallyimportant as several offshore companies (Nescoll Limited, Nielson EnterprisesLimited, Alanna Services Ltd, Lamkin S.

A. Coomber Group Inc and HilternInternational Ltd) have been identified to be linked with their businesses inUK . These companies were mainly used for inflow of funds into UK basedcompanies; which not only acquired expensive properties in UK from such fundsbut also revolve these funds amongst their companies of UK, KSA, UAE andPakistan.

The JIT report also stated that thesecompanies where the Sharifs were acting as shareholders, directors orbeneficial owners were primarily family-owned businesses. These companies wereincorporated in the 1980s and 1990s, when Nawaz Sharif was holding publicoffice.Having said that let’s have a quicklook on how Pakistani Supreme Court reacted. Panamagate case was before the Supreme Court ofPakistan, heard between 1 November 2016 and 23 February 2017. During the case on 14 November 2016, Shariflawyer Sheikh dramatically produced a letter written by Hamad bin Jassim binJaber Al Thani, the Prime Minister of Qatar from 2007 to 2013.

Justice Khosaobserved that the document had “completely changed the public stand of thePrime Minister. Let’s see what Farukh Habib a PTI leader said about all of thedramas of Sharif’s in an interview I took.(F H interview ” 13-50)On 20 April 2017, the Supreme Court in a 3–2decision ruled that there was insufficient evidence to order Sharif’s removalfrom office, but ordered further investigation into corruption allegations. Thecourt ordered the formation of a Joint Investigation Team (JIT) to probe theSharif family’s involvement in corruption as stated in the Panama leaks.

The two judges who ruled against PM Nawaz Sharifhad said he should be disqualified as he could no longer be considered ‘honest’and ‘truthful’ (ameen and sadiq), whereas the other three were in favour offorming a JIT to definitively answer the question of whether the allegationsagainst the prime minister were true or not. The five-judge bench had, however,agreed that it was not satisfied with regards to the money trail provided bythe Sharif family’s counsels.During the JIT’S investigation there were againalot of trouble created by the Sharif’s;July 11, 2017: Maryam Nawaz Sharif was accused by the Joint Investigation Team (JIT) ofsubmitting “fake/falsified documents to the JIT”, which is a criminal offence.According to the JIT report, she and her brothers Hussain and Hassan Nawaz, aswell as her spouse retired Captain Mohammad Safdar, had signed falsifieddocuments to mislead the Supreme Court. JIT report also raised doubts about useof ‘Calibri’ font in papers submitted by Maryam.

The report by the Joint Investigation Team waspublished on 10th July 2017. ThePanamagate Joint Investigation Team (JIT) has found glaring disparities in thefamily’s known sources of income and their actual wealth which it says theSharif family was unable to substantiate.TheJIT’s report on the probe, sections of which circulated Monday evening,suggests that Prime Minister Nawaz Sharif, his sons Hassan Nawaz and HussainNawaz, as well as daughter Maryam Nawaz have been found in violation of Section9 of the National Accountability Bureau (NAB) Ordinance, 1999.”Significantgap/disparity amongst the known and declared sources of income and the wealthaccumulated by the Respondent No. 1, 6, 7 and 8 have been observed,” theJIT observed in its concluding remarks in the report.

“Moreover,irregular movement of huge amount in shape of loans and gifts from Kingdom ofSaudi Arabia-based company (Hill Metals Establishment), United Kingdom basedcompanies (Flagship Investments Limited and others) and United Arab Emiratesbased Company (Capital FZE) to Nawaz Sharif, Hassan and Hussain Nawaz Sharifand Pakistan based companies of Nawaz Sharif and family have been highlighted.But evenafter this Nawaz Sharif did’nt resigned from the post of Prime Minister.(FarukhHabib interview clip)But beside that finally on 28 July 2017, thecourt announced its unanimous decision and disqualified the Prime Minister fromholding public office, finding that he had been dishonest in not disclosing hisemployment in the Dubai-based Capital FZE company in his nomination papers. Thecourt also ordered National Accountability Bureau to file a reference againstSharif, his family and his former Finance Minister Ishaq Dar, corruptioncharges.

There were also accusation against him regardingcorruption, offshore companies etc.Let’s just listen that what PTI leader Farukh Habib hasto say about the case filled against Imran Khan.(F H’s interview)The last thing he told about institutions were underNawaz Sharif govt was exactly what Imran Khan told in the National Assembly.( IK in NA)Noe let’s just discuss the case. The constitutional petition against Imran Khan was movedin Supreme Court by ruling Pakistan Muslim League Nawaz (PMLN) through theirlawmaker Hanif Abbasi on 2nd of November-2016 in reply to Panamagate. In his petition, Abbasi accused Pakistan Tehreek-e-Insaf(PTI) chairman of concealing offshore company, amassing foreign funding viaillegal means, misleading statements in the nomination papers and taking unfairadvantage of tax amnesty scheme.

SC summoned first reply from Khan on Nov-7 and the lattersubmitted his first written stance in form of affidavit on Nov-23rd maintainedthat he bought land in Bani Gala through income earned through legal means. On 18th of May-2017, Imran Khan submitted secondaffidavit stating that he took loan from ex-wife Jemima Goldsmith whilestatement of Imran Khan’s agent Rashid Khan was also submitted with apex courton same day. Khan confessed to incomplete money trail on July-22 whencourt raised undeniable legal questions on the affidavit.

During concludingarguments in the heated up debate in the court, Naeem Bukhari (the lawyer ofKhan) took the stance that his client mistakenly did not declare offshorecompany in the nomination papers but the same couldn’t be termed as anintentional act.However on 14th Nov, Supreme Court granted clean chit toPakistan Tehreek-e-Insaf chief Imran Khan in much-awaited and much-hypeddisqualification case and dismissed all accusations levelled by PMLN s HanifAbbasi. The judgment, as per experts, will shape the political landscape of thecountry amid incessant turbulent atmosphere. The apex court also rejectedaccusations of foreign funding over paucity of evidence and stated that it wasnot mandatory for Imran Khan to declare his offshore company Niazi ServicesLimited.
